Study On Compensation Mechanism Of Emergency Expropriation In Emergency Disposal

In recent years, with the advent of risk society, a variety of emergencies in our country has happened increasingly, such as SARS, the Wenchuan earthquake, the Bund stampede, etc. These events caused huge losses of peoples’ property and life, and resulted in tragedy continually. Multiple and frequent emergencies urged the government to continue to improve the emergency management. Since the SARS in 2003, China has established a emergency management system of "one case, three systems", which played an important role in response to emergencies. But in space with further researching and specific practicing, we found that there are many places still need further refinement in the emergency management. Under the circumstance that reserve emergence supplies is insufficient and dispatching emergency supplies from somewhere is quite difficult after the incident, the government how to access emergency supplies legally and fast becomes a practical and important issues. The emergency needs to be managed quickly because of it’s sudden and uncertainty, otherwise it would cause serious consequences. In that way, in the absence of sufficient emergency supplies, how to obtain urgent-needed supplies for effective disposal is very important. This is the original intention of this paper.Depth study of emergency requisition compensation mechanism not only could complete the study of emergency management in theory, but also play a more important role in practice. Based on the concept of dynamic balance, on the one hand, the government should protect the public authority to take effective emergency administrative action as far as possible at the time of emergencies’ management, so that government can improve the efficiency of emergency management and protect the lives and property of the people as far as possible; on the other hand, after the end of the emergency response, attention should be paid to compensate for a loss of administrative counterpart, in order to appease the administrative counterpart, reduce their losses caused by the emergency requisition. It is more important to be able to improve the executive administrative counterpart’ action to cooperate with the emergency administrative in the future. Based on the concept of the whole process of management, in order to improve the emergency requisition compensation mechanisms, the government should propose the strategic pass and optimize emergency management’s various stages of before, during and after the event.Based on the previous studies, the paper summarizes emergency requisition compensation’s problems in China and analyzes the reason of these problems by means of the analysis to the domestic laws,the emergency requisition compensation measures and several typical cases. Finally, through three-dimensional framework of value orientation, system security, and technical supports the paper puts forward the improving measures to perfect the emergency requisition compensation mechanisms in emergency’s disposal.
