| Bitcoin,as a form of internationalized and digitized coin,is totally electronic and can not be replicated or controlled by neither authoritative department nor individual.Its apprearance is a bold attempt to define a new cryptocurrency,continue the idea of denationalization currency as well.The coin has the two sides.We should never ignore the unprecedented challenge to the traditional legal and financial system behind the crisis of the bitcoin transaction which is spreading around the world.By investigating the background of the bitcoin’s birth and comparing with the legal and electronic money,this paper develops a thorough investigation about the basic theory of the bitcoin and process and characteristic in its transaction, on this account to discuss the problem on the law level in bitcoin bussiness,such as appealing for the rights difficultly after the bitcoin transaction disputes, lacking of available legal supervision on this industry;At the same time,this thesis raises some domestic legal issues about the bitcoin tansaction though analysing a few typical cases.Considering with the foreign law, the treatise brings the final five subjects out, the legal status of the bitcoin,highing up the threshold about the bitcoin trading platform to access the market,clearly defining the platform’s responsibility,taking the platform into fanacial regulation and establishing the international organization against the bitcoin issue.For this advises, I hope to offer my streghth to complete the domestic rule on the bitcoin trade. |
