| Bitcoin into the Chinese market in 2013,but also in this year,CCTV has some reports on the bitcoin,in a long time after the bitcoin has been quietly growing in China,the community is also concerned about the average.Until May 12,2017,the Wannacry worm through the MS17-010 vulnerabilities in a global outbreak,infected with a large number of computers,the worm infected the computer will be implanted into the computer blackmail virus,resulting in a large number of computer files are encrypted.After the victim's computer was locked down,the virus would prompt the payment of the value at the time equivalent to 300 dollars(about 2069 yuan)of bitcoin can unlock,the incident also spread to China.Bitcoin has once again entered the Chinese public view,becoming the focus of social concern.Our Government has noted that Bitcoin is an easy tool to help crime,and at the same time is concerned that Bitcoin has become a huge scale and has created huge financial risks.The emergence of the Bitcoin ICO project in China has a greater risk than the large area of the previous Peer-to-peer credit business,and the government has urgently shut down the renminbi exchange business and the ICO business of the Bitcoin trading platform.However,the Bitcoin risk does not end,in the face of the high network of bitcoin,a paper ban on the extent to how to resolve these risks,still need time to verify,we need to adapt to the objective reality to explore a reasonable regulation of the legal regulations of the road.This paper focuses on the nature and risk of Bitcoin,and puts forward some suggestions,which are mainly composed of the following parts:The first part is mainly the summary of Bitcoin,focusing on the characteristics of Bitcoin,the deep understanding of Bitcoin,the correct understanding of the essence of Bitcoin,from the source to find the root of the problem of the legal risk of Bitcoin.The second part mainly focuses on the risk of Bitcoin,mainly focuses on the macroimpact on the national financial security and social stability,microcosmic on individual investors and market risk analysis.It is concluded that Bitcoin will impact the financial system and monetary system of the country and become the accomplice of the crime in the society.In the micro-currency of the investment market of the irregular and legal status of the instability,investors ' property rights are facing great risks,however,in these areas the state's legal supervision is clearly not enough conclusions.The third part mainly introduces some foreign countries ' typical regulatory strategies and the existing problems in China's supervision,to introduce the next part of our country to designate what kind of bitcoin legal supervision strategy.In the last part,the paper puts forward some suggestions about the risk and supervision of the Bitcoin,and combines some foreign experiences.In principle,we should open and contain the Bitcoin,form a complete supervision system,and scientifically deal with legal risks and problems in the process of supervision.This paper puts forward some legislative suggestions and strategies to regulate the international cooperation of the financial products,Bitcoin trading platform,the real name of Bitcoin,the regulation or establishment of special supervision institutions,the professional legislation and the legal regulation of Bitcoin. |
