Research On The System Of Expert Assistants In Criminal Proceedings

Chinese expert auxiliary system was first established in the new criminal procedure law, and it has its own distinctive significance and value. The legislative content about the expert auxiliary system has been too abstractive, it is thought to be a formal risk because there is a lack of operational specification for the expert auxiliary system in the new criminal procedure law. To this point, this paper mainly focuses on the abundant analysis of current situation between Chinese expert auxiliary system and overseas expert system to learn the useful experience to ameliorate the expert auxiliary system in the new criminal procedure law. This paper will also define the status and standpoint of a expert auxiliary in a criminal suit, and confirm the validity of his opinions. In addition, The focal point of this paper lies in five aspects: the enactment of a expert auxiliary’s qualifications,the appointment of expert auxiliary, the research on the Judicial Expertise Cross-examination Procedure, expert auxiliary’s rights and obligations, expert auxiliary‘s legal liabilities. All these exertions may construct a benefit to promoting the reform of judicial expertise system.
