Research On Natural Person 's Bankruptcy System

Bankruptcy law is rooted in the market economy; it is the basic law to adjust the commodity market. The history of commodity economy in China develop somewhat, But never exceeded the natural economic barriers, the exchange is insufficient, and lack the drive of Bankruptcy law also. With the Reform and Opening-up and the establishment of socialist market economic system, the private economy has developed rapidly, the participate of market for natural person increased than anytime, the range of market main body increased also. Adapt with this, our country enterprise bankrupt law included the non state owned enterprises than the original bankruptcy law, but still hold a negative attitude to the natural person bankruptcy. Whether our country should establish natural person bankruptcy is still a controversial topic.This paper supports the establishment of the natural person bankruptcy in our country, and discussed mainly from two aspects. Fist is the necessity and feasibility of Natural person bankruptcy. The second is the way to establish Natural person bankruptcy law in China.
