The terrorist incidents such as 10 · 28 Golden Water Bridge incident and 3.1 Kunming Railway Station case not only made the domestic anti-terrorism tense situation becoming severe, but also exposed the shortcomings of gun control system. It’s a game between Police shot right and civil liberties, which is reciprocal relationship. This paper is aimed to discuss how to balance Power/Right.Through the analysis of typical cases, the paper describes the shortcoming of police officer using firearms in our country, both the entity system and the procedure system. The entity system defects include: The range of using firearms specified narrow; The application of using firearms is cumbersome; Prohibit using firearms is simple. The procedure system defects include: Lack of specific before & during procedures of using firearms; The approval process of using firearms is cumbersome; Lack of Judicial review procedures of using firearms. Through the introduction of advanced systems, such as the United States, Hong Kong and Japan, we can learn from the experience of developed countries and regions: Focusing on the safety of police protection, making the using firearms operable, strengthening regulation. In the end, I recommend to improve the system of using firearms from the principle, the entity system and the procedure system.
