Judicial Staff To Obtain The Qualitative Study Of Stolen Goods

The behavior that the Judicial personnel gets the stolen goods using his position, is common in the modern society. There are special provision in our criminal law but its definition is confused in theory and practice. In order to find the nature of the provision, the author will analyze the behavior of the judiciary staff by the face value of the law. I will choose a typical case, to show the behavior and the methods, and to make further study on the related charges(such as embezzlement, theft, corruption, etc.),in order to make the punishment fits the crime and answer the hard cases of practice.This subject of the article is divided into three parts, except the introduction and conclusion:Firstly, the author will define the stolen property from easy to hard and sketch the judicial staff and the behavior. We do not have defined the stolen property in our criminal law clearly. So the author will define the stolen property as the property gotten in crime from the change process and its connotation and external in detail. The judicial staff is the person who work on the investigation, prosecuting, judgement and supervision. and sketch the meaning of judicial staff and the behavior of getting. The behavior of the judicial staff getting the stolen goods is to get the goods by legal or illegal, proper or improper methods.Secondly, the author will describe the style of the behavior. In this part, the author will take the case in the introduction for example, to discuss the behavior of the judicial staff getting the stolen goods in criminal law. the behavior has three types: embezzlement, stealing and perverting the law and so on. If the author describe the three types clearly, it will has positive function in the study of behavior.Thirdly, the text will determine the nature of the behavior. In this part, the author will talk about the charge that the staff would get to show you the content of the study from the nature and the constitutive requirement of the similar crime. To the embezzlement,the author will discriminate the crime of encroachment, corruption, shielding or concealing the illegal gain. To the stealing, the author will talk about the stealing from the larceny and crime of corruption. To the perverting, the author will show you whether the behavior bending the law for personal gain. The author will give us the futher thinking from the studying of the several behaviors.
