In recent year, with the dramatically rapid development of economy and urbanization, more and more collectively-owned lands are expropriated, which gives rise to a fact that the number of farmers who lost land becomes sharp increase, However, our state collectively-owned lands expropriation system exists flaw, which results in a severe problem that the dispute on collectively-owned lands expropriation emerges endlessly. This problem does farm to the process of the rule of law and constructing the harmonious socialist society. How to perfect collectively-owned lands expropriation and the related law becomes an universe focus,which not only makes our rule of law improve but keep balance between the need of state lands and protection on farmers’ legal interest.There are many shortcomings on collectively-owned land expropriation system.They are indeterminate public interest,unreasonable compensation system, incomplete procedure on relief, incomplete power and functions and so forth. In order to regulate collectively-owned lands expropriation action and perfect along with create collectively-owned lands expropriation compensation system,this paper aims at perfecting our related regulation from the following aspects, transforming legal concept, reasonably defining public interest, improving compensation standard,defining ownership system,which is on the basis of the chance of enacting collectively-owned lands expropriation compensation regulation. According to what have mentioned above, the problem of collectively-owned lands expropriation compensation will be resolved reasonably as long as we coordinate the benefit between the public interest and personal interest, and our country establish a legal and long-run compensation system.
