The Internet has been integrated into the economic, social, life, is a tremendous impetus of hitherto unknown greatly changed people’s life form. People through the Internet to break the constraints of time and space, and from all over the world, people from all walks of life exchanges, argue, can also be timely informed about the latest news and information, remain within doors can know the world events. In view of this, no more can promote the development of freedom of speech than network platform. But the network also "not negative comments of the people’s expectations. Network have the aid of free public opinion, expression of ideas, inself satisfaction at the same time also continuously promoting the social democracy, to a certain extent, ease the social contradictions.However, from a practical point of view, the network is a double-edged sword. To inject new vitality into the development of the network in to the freedom of speech at the same time, the characteristics of Internet anonymity, openness, speech in the Internet is easy to privacy right, reputation right of citizens caused varying degrees of damage of over expansion, and even affect the long period of stability and social harmony and stability of the country. The law forbids the absolute freedom to appear, but the absolute freedom also means no freedom, therefore, to regulate the Internet speech is very necessary.This paper starts from the basic theory of the constitution of the freedom of speech on the Internet, briefly describes the connotation of the freedom of speech and freedom of speech on the Internet, and then analyzes the network freedom of speech is different from the traditional characteristics of the freedom of speech and of the individual and social value, and then from the actual situation, the conflict between the freedom of Internet speech and individual rights and public interest, which leads to the necessity of network speech freedom, after discussing the American and German regulation speech network situation analysis of China’s current legal regulation, and the regulation of Internet freedom of speech should follow the principles and specific boundary. Finally, from the legislative, administrative, judicial autonomy level as well as the industry point of view put forward some suggestions, in order to regulate the Internet freedom of speech can be reasonable, improve the relevant system construction.
