A Study On The Value Conflict Of Contemporary Chinese Social Transformation

At present, China is in the transition from agricultural society to industrial society, from traditional society to modern society. The original social structure break in this transformation process, the change in social structure, also appeared a lot of social problems. The emergence of these problems, to a certain extent intensified the social contradictions and negative influence for the establishment of a stable and orderly social structure. Social transformation refers to the society by the form of change to another form, that is a major shift in the structure of society. During the period of social transformation, the old and the new era of alternating transition stage, blending and stirring old age will make the value conflict and value conflict in this period is very intense, and people’s values will also be changed. This phenomenon is in the value of the performance is very outstanding, in the past due to the imperfect legal system theory of rule of law is not perfect, the more we advocate political values such as democracy, freedom, dignity and some traditional law values and so on. With the construction of rule of law, the concept of a socialist country under the rule of law of value, should also play its inherent, to maximize the maintenance of human dignity, and make it become an important target of policy.In this paper, through the development of China economic review after the reform and opening up, social transformation background, to explore the value of conflict law, reason and so on, the method to solve the value conflict of the principles and methods.The first chapter is the overview of the contemporary transformation of Chinese society, mainly summarizes the meaning of social transformation, and the development of the rule of law. First of all, to clarify the meaning of social transformation, from the current Chinese social and economic development, the change of social structure and social transformation of the meaning of understanding. Followed by analysis of the social transition performance. From the system level, economic level, social organization, values, social life level summary form of social transformation. Finally summed up the rule of law in China before and after reform and opening up the development process and achievements.The second chapter mainly discusses the value conflicts during the period of social transformation method. The meaning and the performance including the value conflict of law, value conflict of law mainly from the perspective of value subject between utility and non utility point of view, the purpose and means of leading social value analysis and value conflict of law.The third chapter mainly analyzes the reasons of the value conflict of law. The main social reasons, namely the value conflict of law including the effects of external impact, the impact of the traditional society of the western capitalist society and socialist market economy. Second is the main reason, namely the internal value of law, including the subject pluralism, diversity and multi levels. At the same time also includes the cultural causes of conflict law value.The fourth chapter this chapter mainly discusses the way to solve the conflict of law of value, mainly divides two aspects to elaborate. One is to comply with the basic principles of perspective to explore the solution method, including the following conflict law value hierarchy principle, balance principle and case. On the other hand, including conflict law value solution are re positioning of the function of law, establish the core value of law concept, establish the authority of law and so on.
