Research On Object Of Environmental Crime

Nowadays the environmental problems have become one of global issues to influence human survival and development. Many countries try to solve the increasingly serious environmental problems by setting out environmental criminal law. The reason that the interests have not been described clearly in criminal law,there is a academic debate in academic circles. Although each theory has its reasonable reason, they do not present us a unified point of view. In the perspective of environmental criminal object, the writer makes a study of the basic theoretical questions and tries to redefine the object of environmental criminal law. There are four parts in this paper, total thirty million words. The main content:The research background and significance of the paper are mainly introduced in the introduction.The first part mainly makes overview of the object of environmental crimes.Chapter one mainly introduces the understanding of the object of environmental crimes and the characteristic of the object of environmental crime. The object of environmental crimes is elaborated from two aspects: traditional and contemporary understanding of the object of environmental crime. only making a certain understanding of the object of environmental crime, the environmental crime behavior could be judged whether constitute environmental crime or not. All descriptions mentioned in above are necessary preparation for next research.The second part is mainly to sort and evaluate domestic and foreign environmental crimes theories. There are many types of object of environmental crime in domestic. Firstly making introduction and analysis of some main point, the writer makes introduction and analysis of environmental crimes theories in foreign including Germany, the Unite State and Japan.The third part is mainly about relevant provisions of the object of environmental crimes and its shortages. Comparing domestic and foreign object of environmental crimes to analyze, on the basis of combing the current relevant provisions, the shortages of object protection are presented in the environmental criminal law,including low position in the Criminal Law and narrow protection range in Criminal Law.The fourth part is the redefinition of environmental crime object and adjusting the legal system. Based on the deficiency of environmental criminal activities, the writer puts forward that the object of environmental crime should be its benefit. And then the paper is analyzing the benefit connotation and denotation, the reason and significance of environmental crime. The writer makes suggestions that environmental crime should become one chapter separately in law and legal structure.At last, the proposal that some new charges are added in law is put forward.
