Theoretical Analysis And Enlightenment Of Restorative Justice Cases Of Forest Protection

Restorative justice is associated with the traditional criminal justice system slow, costly, inefficiency, and ignore the victim interests disadvantages including appeared, it is the criminal justice process provides a new paradigm, it also caused the attention of the legal science and practice in our country.Especially with the people environmental protection consciousness ascend, the growing of forest protection concept, make the judicial organs for criminal cases of forest destruction series of restorative justice. This paper is given priority to with case analysis method, from the domestic three case of restorative justice, this paper analysis of restorative justice to forest protection and bring the change of many aspects, such as criminal justice, and from the macroscopic level concerns the application of restorative justice in the necessity and feasibility of damage cases such as forests, finally proposed based on the analysis on the existing judicial case revelation to the perfect development of restorative justice, hope for the future of restorative justice to perfect and solving practical problems in judicial practice faces help.This paper is divided into three parts: the first part is the current domestic forest protection restorative justice practice basic situation of typical cases are summarized,and analysis to extract the main problems existing in the practice.The second part: the similar case is introduced to analyze the necessity and feasibility of restorative justice, for the application of restorative justice better starting protection provide theoretical and practical basis for judicial practice.The third part: through the analysis of the current forest cases the problems existing in the exploration of restorative justice, summed up the perfect revelation of restorative justice in our country in the future, accordingly the prospects for application of restorative justice in our country starting protection to make paper.
