New Exposition Of Community Correction In The View Of Restorative Justice

Restorative justice has become research hotspot in criminal law experts. Since it was introduced to China. Its restoration concept has received the people's favor in the existing criminal justice system seems to be quite helpless against crime. Now while its effectiveness and feasibility still have many questions, but in many countries it has d becomes more mature criminal handling pattern. It is also widely applied in the non-custodial sentence. Many developed countries and regions draw on the concept of restorative justice and make a change in the criminal justice system. Especially community correction's decision and implementation of the system also made a lot of innovation, which has changed people-centered model of crime in the past. It pays more attention to a variety of value realization. This article is intended to examine our practice of community correction which is being carried out by the concept of restorative justice to make a useful exploration in the use of restorative justice for community corrections. This paper is divided into four parts; The first chapter is mainly to define community corrections and restorative justice concepts and relations between the two. Chapter II focuses on China's current practice and problems in community corrections. The second section deals with the meaning and feasibility of the introduction of restorative justice in community corrections. First, I clearly analysis the concept of restorative justice. Subsequently I point out the significance of the restorative justice for Community correction. Finally I Described the feasibility of the introduction of restorative justice concept to Community Corrections. Chapter IV examines the first extra-territorial community corrections and restorative justice integrate. Then I put forward the vision of restorative justice under the in perfecting China's community correction system approach from the community-based prevention, rehabilitative community-based correction of decisions and the implementation stage.
