Since the end of the century, China’s real estate industry got a rapid development, and became the owner of a decisive role in our national economy. Speed increasing every year but prices far beyond the income growth rate of the general population, to buy a house is difficult to become a haunt of many Chinese people’s real problems. Then many consumers choose to buy a small property room. But in our current urban and rural land ownership, small property development, construction and sales are illegal. Small property exists upset the market order, endangering national security arable harm the interests of consumers and harm social stability and other aspects of the drawbacks of small property room for effective regulation is imminent. However, because of the presence of defects in the abnormal development of China’s real estate market, the imbalance in housing supply and demand, China’s current land and other real estate system and the impact of multi-stakeholder, etc., our government regulation of small property management has been unable to achieve good results, small property development and construction repeated. In this paper, through systematic analysis of the development and regulation situation of small property, summed up our country at present in the process of regulation of the housing of small property right exists the following problems: the low administrative efficiency in the course of regulation, policy can’t be effectively implemented, regulation policy of farmers, lack of support, regulation policy law according to the lack of. And the reasons are analyzed: land management legislation lack of continuity, government regulations at all levels of the starting point of the small property room is not unified, etc.. Finally according to the analysis of effective government regulation of the housing of small property right puts forward a few suggestions: the existing small property right of classified management, the reform of rural land property rights system, reform perfect land expropriation compensation system, improve the urban housing security system, from the perfect regulation construction of organization. In order to provide a theoretical reference for the national regulation and management of the small property room problem.
