Our country’s new revised "law of criminal procedure" in 2012 has provided the criminal reconciliation system of crime. The provisions of the new "criminal procedural law" in the crime of medical accident is that the application of criminal reconciliation system. Otherwise, in the judicial practice,many traffic accident cases are adapt to criminal reconciliation and most of those cases have achieve many harvest. The crime of medical accident has many similarities.There is also a considerable part of the application of medical accident crime of criminal reconciliation system in judicial practice. However, when the application of medical accident crime is in the criminal reconciliation system, it will has many problems need to be solved during the execution of a program because of its own specificity, just like the main bod y is not clear,the subjective elements are complex,identification content is confused,we do not know what happens when the reconciliation is not come to an agreement. It won’t make the application of criminal reconciliation system in crime of medical accident more perfect until these problems can be solved well.
