On The Application Of The Rules Of Treaty Interpretation In WTO From The Perspective Of Sino - American Electronic Payment Cases

The treaty interpretation is an essential part of WTO dispute settlement report. As the complexity and ambiguity of the WTO rules,the Dispute Settlement Body has to interpret and analyze it before the finding. The interpretation has great influence on the cases and the application of the WTO rules in the future.This essay is intended to summarize the application of the treaty interpretation in WTO by analysis of the case of “China--Measures Affecting Electronic Payment Services”. It is composed of five parts:the introduction of the case of “China--Electronic Payment Services”;the general rules of treaty interpretation;the treaty interpretation of WTO rules;the panel’s interpretation of the WTO rules in the case of the “China-- Electronic Payment Services”;the comparison of treaty interpretation between WTO rules and the rules in the Vienna Convention on the Law of Treaties.
