As the reform of the legal system goes on, new additions have been made to the legislation of inheritance debt. But detailed specifications and clear statements are still to be desired.The foreign civil law systems and common law systems have provided valuable reference models of the settlement of the estate debt as well as considerable amount of data for research in the area of dealing with the disputes in the real world, which centers on the debt upon unpredictable death and the debt after inheritance is completed.Obviously, laws and regulations regarding complicated inheritance disputes constitute an important step to upgrade the legal system.This paper introduces the problem of inheritance debt clearance and analyzes the complexity of disputes over these issues. A comparison is made between different cases and systems between the Chinese and foreign legal systems.the limited succession and legacy of debt definition should serve as a key component in revising the debt liquidation system. The distinction of limited liability, unlimited liability and shared liability will remain a cornerstone for the legislation of inheritance debt liquidation.
