In the judicial practice of people’s courts at all levels, the infringing property type crime has been high, of which the most common is the crime of theft, embezzlement, fraud, the three kinds of crime constitution of crime is very similar, so in theory and judicial practice often appear this kind of circumstance, is the same suspect behavior, will whether there is a crime, what constitutes a crime of disagreement and debate. The author takes Wu of credit card fraud case of disputes in this life for the entry point, through the discussion of the controversial case, combined with the actual case to discuss the differences in some special criminal cases these charges, in the paper the situation, Wu. Eventually this conclusion should be characterized as a crime of credit card fraud and theft.. This article from the whole frame is divided into four parts.The first part through an actual case study introduced the basic situation of the case, the court trial and controversial points, proposed the author to explore the issue, whether the suspect in the case of Wu’s act constitutes a crime, what constitutes a crime. The second part is mainly to put forward the problems in the case of dispute point for further analysis, the concept of credit card, credit card fraud and constitute elements of the interpretation. The third part of the "guilty" or "not guilty" were controversial analysis and the legal nature of the defendant behavior in the case of a qualitative description of the defendant, in accordance with the method of withdrawal of different judged respectively constitute the crime of credit card fraud and theft.
