On The Exercise Of Counsel 's Right Of Defense In Investigation

In this paper, we analyze the concept and characteristics of the lawyer’s defense right in 2012 Chinese Criminal Procedure Law. And analyze the problems of the right of defense in the judicial practice. Through the analysis of the status and characteristics of the lawyer’s defense right in criminal investigation stage, this paper try to find the method to solve the problem. On how to protect the right of the lawyers meeting right&right of investigation and right of complaint,establish a new system of lawyer’s marking power&right to questioning in criminal investigation stage.At the same time, through the establishment of the detects detains separation system, perfecting lawyers’ practice of security system, to provide a system security in the investigation stage of lawyers.
