A Study On The Legal Problems Of College Students' Personal Injury Accidents

With achievements of great success in education career and raising number of college students, college students’ injury accidents are increasing at the same time, which brought new challenge and pressure on students’ management work in colleges and universities. Students’security problem on campus has become the focus of society, school and parents. This kind of injury accidents don’t occur recently, but they do happen more frequently than they did in the past. On study of students’ injury accidents, much attention was paid to primary and middle school students, while to college students, it was with little concern. From existing research results, some scattered, non-systematic researches were found. They have no organic unity and coordination between systems, no combination of theory and practical research, which can be difficult to be used to solve practical problems effectively.This paper mainly analyzes and studies the legal and practical problems encountered in the process of college students’ injury accidents, which mainly includes definitions home and abroad of the legal relationship between students, the legal relationship between school and students after accidents, the nature of civil liability shouldered by school. At the end of the paper, the risk sharing mechanism to improve college civil liability, advices to establish and perfect the legal regulations were raised up. Besides, some suggestions to revise and improve the existing laws and regulations were put forward. The paper is divided into four parts. The first part is the general introduction to the whole paper, which explains the background, significance of the research, literature review, writing purpose and methods. The second part is the legal relationship between students and schools, which deals with the legal structure of civil liability in the event of students’personal injury accident. The third part classifies different college students’ injury accidents based on the characteristics, after which analysis and demonstration were carried out. The fourth part is to make reasonable suggestions on current college students’ personal injury accidents in the term of legal problems and countermeasures.
