The Third Party Electronic Evidence Preservation System Of Net Loan Platform

The paper discusses the third party service provider for evidence preservation mechanism in internet lending platforms, analysis the issues arising from this field and provides some suggestion to govern this field.The first chapter of the paper discusses the concept of digital evidence and internet lending platforms, in which we may reach a consensus about the necessity of evidence preservation mechanism for internet lending platforms. During the second chapter of the paper, the author introduce the law enforcement for third-party digital evidence preservation mechanism, including the Civil Procedure law and the Electronic Signature law, and the practice of third-party digital evidence preservation service provider, including Unitrust company, Ancun Company,and Lvgou Company, etc. In the third part of the paper, the author introduce the digital evidence preservation methodology adopted by those service provider, including the digital signature encryption, online notarization, judicial evaluation, and direct deposit. In the end, the paper discusses the issue may arise from those methodology and provides some suggestions for those issues.
