Virtual property, as an innovative type of property, the issue of its succession is also increasingly being referred to in the real world. Whether people’s virtual property can be inherited or not, how to understand the legal nature of virtual property, and how to construct the inheritance system of virtual property are all becoming problems. Due to the absence of law, the inheritance of virtual property is often caught in an awkward position. In this context, I think that we need to update the succession law to make sure that virtual property is a content of it. By doing this, we can maintain the stability of economic, we can protect the value of virtual property and development of new industries. We can also build a better society ruled by law and reduce social conflicts from happening.This paper can be divided into seven parts. The first part is an introduction. The author introduced the purpose and background information in this section, especially focused on the legal nature of virtual property by using case-study and comparative analysis. The second part is an overview of the theory, included the concept, features and the classification of virtual property. It clarified the scope of this article, at the same time, introduced the theory about the nature of virtual property. The third part of this article clarified the meaning and rationality of the inheritance of virtual property. The forth part introduced the status quo of virtual property inheritance in China. This section also elaborated the dilemma and urgency which facing virtual property inheritance mainly through the way of case study. The fifth part of this article introduced legislation of virtual property inheritance in Germany, South Korea, Hong Kong of China and other countries and regions. Compared with those countries and regions, China’s mainland must clarify the legal status of virtual property as soon as possible and to enhance the guiding role of judicial interpretations and precedents. Part VI detailed how to build the virtual property inheritance system, including how to determine the inheritance body, how to delineate the scope of the inherited virtual property, and so on. The seventh part is the conclusion.
