Research On The People 's Jury System In Criminal Trial

The people’s juror system is one of the most important legal systems in our country. With the special background of the new round of judicial reform, the people’s juror system reform is picking up. Our people’s juror system is not native, but afferent. This paper examined the development of the people’s jury system in China. Comparison of the many changes in the two reforms of people’s juror system was also involved. In the investigation of people’s jurors’system running status, it analyzed the shortcomings of its existence. And on the basis of analyzing the shortcomings of its existence, some Suggestions of perfecting the people’s juror system were put forward.The paper is divided into three parts:the preface, text and epilogue. Among them, the text is divided into four chapters.The first chapter was an overview of basic issues of people’s assessors, and was divided into a total of three sections. The first section introduced the concept of the people’s jury system, and summarized its unique characteristics. The second section examined the development of the people’s jury system in our country. In the third section, comparative study of the twice of people’s juror system reform was carried on. From the aspects of qualifications, election procedure the scope of assessor and mechanism, assignment of responsibility, exit and disciplinary mechanism and the protection of their duties, this section made a comparison.The second chapter concluded the study of our system of people’s assessors’ operation status, Analysis of the deficiencies in the operation process was also involved. This chapter was divided into two sections. The first section described the people’s juror system from the aspects of quantity and structure of the running status. Analysis of the disadvantages was in the second quarter. Among them, the phenomenon of "hold rather than accompany" "accompany rather than try" "try rather than discussion" etc. was particularly outstanding.The third chapter analyzed the value and function orientation of the people’s juror system, and was divided into two sections. The first section analyzed the diversity of our people’s juror system value. The second section analyzed the function of the people’s jury system.The fourth chapter put forward some suggestions of perfecting the people’s juror system, and was divided into six sections. From the aspects of function to clarify, role orientation, scientific assessment, procedure’s supporting and supervision management, some suggestions was put forward.
