The Perfection Of The People’s Assessor System From The Perspective Of Judicial System Reform

People’s assessor system in China has been widely discussed which was not in the eye of public attention before. As a legal trial system, it is generally considered to be the connection between the masses and the people’s court, which is the necessary requirement of democratization of judicatory in socialist country. However, since the limitation of traditional concept, the negligent of regulations during draft and lack of fund investment, ect, there are many negative results come along the reasons mentioned above, such as the unhealthy mode of participation of judge, the unspecific work of juror, the absence of regulations, accompany but no trial, meeting but no judge, unreasonable targeting, the absence of supporting systems and other issues. With the continuous progress of judicial reform, "Strengthening of judicial democracy" and "guarantee of justice", "power to strengthen supervision effectively and deeper reform of judicial system" are all the requirement for the selection of people’s assessor, definition of rights and obligations and improvement of supporting system, even stimulation and demand of the according administrative operating system in court. This thesis is based on the phenomenon mentioned above and combined with the current reform of the legal system of judicial background to give appropriate research, and strive to improve the people’s jury system.
