Over the past 2 decades, the questions arising from the markedly change in global weather is a major concern to all countries. Notably, the enormously increase of greenhouse gases caused infinite harm to our health. According to the 5th report of IPCC, there is no doubt that our weather is getting warmer. The developing counties are more likely to be effected by the weather change due to the limited coping capacity. Under that circumstances, the Carbon Capture and Storage Technology (CCS) is invented. However, this technology haven’t get fully developed due to several obstacles. The biggest problem is the unbalance between supply and demand of fund limits the further research, construction and development of CCS. How to scientifically manage the fund is critical point of CCS.This report systematic analyzed problems of CCS and shed a light on the law backgrounds. By discussing the "source" and "manage" of different fund type, we raised the suggestion of putting forward about binding international treaty, the treaty systemic lack of structure defects of international financial organizations and private capital that resulted from the obligations of the parties fails to perform, generalized capital of the carbon market, and the legal system of the green climate fund. Under the convention on the above questions, put forward in the face of such problems as lack of capital contribution obligations of solution. At the same time, making recommendations to the Chinese government, in the context of global climate governance reasons and advantages of the advance of the technology.
