The Realistic Dilemma And Legal Countermeasures Of War Refugees

War refugees have always been a problem to our international society, therefore hindering the development of all the countries. The causes of war refugees can be rooted ever since, and religious conflicts, regional conflicts as well as terrorism have exacerbated this problem, in return, instability of the concerned countries or regions has been aggravated because of it. War refugee issue has become a stumbling block to world peace and development, and today it has become an important work for the international community to figure out how to effectively solve this problem.Solving the problem of war refugees is a way of embodying the humanitarian spirit, and also it’s the common ground to fulfill the development and stability of the international community. To our great relief, the international conventions and national domestic legislation on war refugees have come to mature, international organizations and other agencies are also actively fulfilling their role of aiding the refugees; however, considering the complexity of this problem, it is not possible to be properly resolved overnight, but it takes a long time to make unremitting efforts. It demands not only the effective war refugee protection legal system, but also co-operation of all the states as well as all kinds of organizations. Therefore, this paper focuses on tragic status of war refugees through the typical examples of war refugees, looking forward to attracting public attention to this problem.lt focuses on the analysis of the lack of legal protection for war refugees in real life on the basis of international legislation, and it makes an analysis of the concerned international legislation and its insufficiency. In the end, it presents the corresponding improvement proposals to expect that the problem of war refugees could be resolved quickly and effectively. Addition to the introduction, the text is divided into three parts as follows:Part 1:the introduction of the problemFirstly, it makes a brief introduction of the typical case of war refugees to;secondly, it analyzes realistic dilemma of the war refugees and points out the negative social impact of war refugees; and finally, it highlights the innovation of studying the war refugee issue.Part 2:the definition of war refugees and the evolution of the protection policiesOn the one hand, it explains what war refugees are and gives a better definition by making comparison with other types of refugees. On the other hand, it makes an analysis of protection policies, providing a practical basis for the afterwards legislation transition; supported by presentation of two war refugees aiding institutions-the International Union and the UNHCR, it clarifies the purpose and the background of the set-up of the war refugee relief agencies as well as the evolution of the war refugee protection policies.Part 3:the legislative investigation and the perfection of legal countermeasureFrom the prospective of international legislation, it makes an analysis of the legal provisions on the protection of war refugees, choosing the representative legal documents from the international convention, regional and national law; in addition, considering the difficulties that war refugees encountered and the lack of international legislation, we put forward legal measures to solve the problem of war refugees and propose practical advice to protect the interests of war refugees from the perspective of international law.
