The Definition Of Infringement Right Of Reputation Right In Network Environment

The purpose of this paper is to define the infringement limits under network environment.This article clarifies the basic concept of connotation between the reputation and the reputation right and the real right of reputation and right of reputation network, on this basis, then clarifies the definition and limitation of rights, the definition of infringement, infringement and network reality different from the right of reputation infringement.And then discusses several encountered infringement under the network environment in the process of popular concern, and further discussion related to these problems.The research methods used in this paper are the main research method, such as study method, interdisciplinary research method, literature research method based on summing up and so on. On the basis of summing up predecessors’ experience, according to the opinion of the teacher and the interest of the individual, using literature research, access to relevant information, the research focuses on the problem of tort definition of limit, is advantageous for the concept from theoretical and practical problems of definition and classification of infringement. Reputation infringement limit under the network environment leads to the complex argument in the current increasingly under the Internet environment. With the changing behavior and development of the society, the network information problem becomes complex,and the information communication mode will gradually enrich the corresponding network environment, rules, system,then the norms will gradually become refined. What is more importantly, reputation tort phenomena cannot be all listed under the network environment, can’t completely summarized.Its limit is defined in the following basic laws and regulations, the premise of needs to use good faith the objective criterion of a good man to assist. Therefore, by means of case study method, the author emphatically select several special reputation infringement problems, in order to define infringement limit. Network environment is complicated, with the progress of Internet technology, network has brought people convenient communication and a series of problems at the same time, including the Internet rumors spread easily spread, network decay information eroded people’s hearts, network fraud emerge in endlessly,.These problems not only caused road network rights difficulties and obstacles, and affected the network clean environment and good atmosphere. Through interdisciplinary study method, the computer knowledge and legal tort issues makes it easy to understand the status of the tort of environment.
