Research On Network Reputation Infringement Problems

As internet has been becoming a new communication media since the end of 20 th century,it has developed very quickly and made a huge influence in every field of our society for its development and popularization.Being a service platform,it provides us with a new platform.Through the platform,people can spread knowledge to everyone openly.However,under the background of network globalization,the Internet has brought us new problems such as internet infringement at the same time based on its characteristics like wide spreading,swift spreading,openness,across localization,virtuality and instantaneity.As it's known to all,the Internet has been a distributing center of internet infringement as all kinds of indecent events occurred untimely online.These indecent events include nude picture scandal,drug taking,derailment of popular stars,gambling,etc.More and more network mobs,a certain public figures and their fans spread all kinds of harmful information through internet media such Weibo,QQ,forum,post bar and wechat.These uncivilized behavior not only occurs right infringement towards others and lower their social evaluation,but also pollute the internet environment and spread negative energy to the society.After all,these activities will cause a huge influence toward society.Because of the internet infringement's particularity,there is no relevant law to restrict these behaviors.So,when a certain internet infringements occurres,the judge has to solve the problem according to the traditional infringement law which will cause other problems.Thus,how to use law to protect the victim of infringement has been a concern of the society,and a new method of solution to these incidents is becoming more and more urgent.It needs us to study and explore further.This article analyzes some classical legal cases and introduces some questions.According to study the cases one by one,the writer makes some suggestions based on the practical situation.The article contains five parts excludes introduction and epilogue:The first part introduces a certain domestic classical legal cases and poses questions through analyzing them.The second part states the concept of internet infringement and mainly discusses the particularity and the tort ways of infringement.The third part states the main constitute of internet infringement,and discuss them based on internet infringement behaviors,damage result,causality and fault.The fourth part states tortuous liability constitutes and defense reasons.The article will elaborate infringement subjects at first,then analyze the responsibility,at last discuss the remedy mode of infringement responsibility and defense causes.The fifth part poses suggestions of legislation,establishing the real-name system,strengthening self-discipline and improving the internet moral construction.
