Research On The Current Situation And Countermeasures Of Public Opinion Crisis Prevention And Response In Court

In recent years, accompanied by the development of the economy and society, the public idea and the consciousness about the rule of law are increasing gradually. Especially confronted with the rapid development of new media and the profound changes of the media circumstance, a variety of "defect" "inadequate" and "error" of trial or enforcement activities of the people’s court had been exposed frequently. What is worse is that the rumors relevant to court have emerged from time to time. The court’s crises are occurring again and again because of the complex background mentioned above. Faced with the fierce public sentiment and criticism, the consciousness as well as the capacity and mechanism of the court about the crisis management can not keep up the significant development of the situation. This paper analyzes the crisis that the courts have faced with and puts forward some constructive opinions and suggestions.This paper is divided into five parts. The first part is overview. It generalizes the concept of the crisis, thecrisis of public opinion, the court of public opinion crisis, focused on analyzing the characteristics of court public opinion crisis, such as procedural justice has become an important incentive, substantive justice has become the main topic, judicial politicized, entertainment tendency and so on. The second part analyzes the current situation of public opinion crisis faced by the court. This part points out that the current public opinion crisis of the court has a high incidence of crisis, secondary crisis, public opinion crisis in the grassroots courts and violence and other incidents of judges, etc. The third part analyzes the causes of the crisis of public opinion in the court. In the internal reasons, judicial power operation is not standard, the quality of the judges is not high. In the external reasons, pay attention to substantive justice ignored procedural justice, rights and obligations of non equivalence, weak public awareness of the rule of law, public opinion to discredit and other factors. The fourth part analyzes the problems of preventing and responding to the public opinion crisis of the court. This part puts forward some court ideological issues, system construction lag, lack of ability and awareness of global problems. Thefifth part puts forward some suggestions of preventing to deal with the crisis, such as perfecting the laws and regulations, establishing a new system, clearing judicial responsibility, strengthening professional guarantee of judge, creating professional community, constructing and interacting between medias and so on.Through the analysis and review of five parts, this paper is designed to constantly improve the prevention and response of the current public opinion crisis of the court.
