On The Establishment And Perfection Of The Penalty Mechanism Of Minor Criminal Crimes In China

On the basis of the concept of minor crime penalty law system, this article demonstrates the independence of the system, examines the overseas related system and relevant experience, analysis the practices in perfecting the management mechanism and the education correction, ect.Finally, based on the existing problems in our current system, this article mainly from the point of practice puts forward some proposals for perfecting the minor criminal offenses penalty system, including: improving the case diversion and simplifying the trial proceedings, establishing the specialized minor crime penalty institutions, that is, magistrate’s courts system, meantime, perfecting the minor criminal cases penalty adaptation and the system of education correction, ect.
