Research On Patent Protection Of Graphic User Interface Design

Computer graphical user interface is the medium of human computer interaction, which greatly improves the convenience of computer operation. An Excellent graphical user interface design combines the operational, functional, artistic, which made great significance to enhance the competitiveness of electronic products. As the special nature of the graphical user interface and the characteristics of easy to copy and imitate, the protection of intellectual property is difficult to place. The traditional laws, such as copyright law, patent law, trademark law, anti-unfair competition law, are all lack of clear boundaries between the protection modes. A reasonable and effective system of intellectual property protection is necessary to meet the needs of the graphical user interface protection, promote the healthy development of electronic information industry, and to encourage the application of computer software development.The graphical user interface protection system in our country has just started. Through the revised patent examination guidelines, China has incorporated the graphical user interface into the scope of protection of design patent in 2014. This is a change from scratch; however, it is still difficult to meet the requirements of practice, and lack of certain rules for the operation. It is necessary to learn from the system experience of the developed countries to improve the shortcomings.This paper compares the graphical user interface protecting situation of the domestic and foreign, put forward some suggestions in view of the existing problems. This thesis consists of four parts, the first part discusses the concept and characteristics of graphical user interface. The second part introduces the graphical user interface protection about the United States, the European Union, Japan and other countries and regions, and summarized some rules. The third part analyzes the problems and causes of the graphical user interface protection in our country. Finally it discusses the present situation and the development direction of the graphical user interface protection system. Suggestions on the protection of the graphical user interface in China are provided, including expansion of the scope of the object; start Partial Design system; reasonable classification and differential protection.
