Macao Trademark Protection Legal Issues Discussed

Through comparatively researching the legislation on protection of trademark in Mainland China and others countries, with the Paris Convention and the Agreement on Trade-Related Aspects of Intellectual Property Rights(TRIPS), the author analyses the success and drawbacks of the legal protection system of trademark in Macau. In this thesis, the author discusses the legal protection of trademark in Macau, relating the theory with the reality. Referring to Mainland China and the foreign experiences of legislation, the author puts forward way of perfecting of the legal protection of trademark in Macau. The whole thesis is composed of four chapters except for the preface and the conclusion. They are as follows: Preface is about the main issues that are to be discussed in this thesis. The practical value is pointed out here. Chapter One is about general demonstration the legal protection system of trademark in Mainland China and others countries. The author also introduces the influence of the Paris Convention and the TRIPS to the legal protection system of trademark in the world. Chapter Two deals with the legislation on protection of trademark in Macau. Through the comparison of the Paris Convention, TRIPS and others experiences, finds out some drawbacks in the current system. Chapter Three pointed out the drawbacks of the legislation on protection of trademark in Macau. Chapter Four is about the analyzing and perfecting of the legal protection system of trademark in Macau. The author focus on the success and experiences of the protecting trademark in Mainland China and others countries to put forward way of perfecting of legal protection system of trademark in Macau. In the conclusion part, the author generalized his main ideas on the legal protection of trademark in Macau.
