Predictability Of Theoretical Research

The thesis is mainly on the foreseeablity theory, which is the centre of damage liability concerning contract law and torts law. This article includes four parts. Part one analyses the basis of the foreseeablity from the aspects of Psychology, Behavioral on Science, Sociology of Law, Economics of Law, Value of Law and Civil Law. Part two studies the structures of the foreseeablity, including party, damages, time and standards of care. Part three studies the use of the foreseeablity, especialy on negligence and legal causation, which. can direct the judicial practice. part four analyses the present legislation of our country and the sense of the foreseeability to the judicial practice of our country.
