On Commutation System

This article contains five-parts. I Outline of Commutation System. This part introduces the Origin and development of Commutation System in China and then expounds the concept -~ characteristics and significance of Commutation System. II Theoretic basis of Commutation System. In this part I explain the theoretical grounding of Commutation System in the west and the Soviet Union: Subjectivism-~. Theory of penalty of Aims~ Principle of economizing of the execution of punishment-~ Principle of socializing of the execution of punishment and Max抯 Materialist dialectics. Meanwhile, I elaborate the specific theoretical grounding of Commutation System in our country: Thought that Man抯 thoughts can be remolded~, our penal theory of the unity of subjectivity and objectivity~ our penal policy of combining punishment with leniency. III Applying of the Commutation System in our country. According to new criminal law of 1997 the part objectively expounds the applying of the amended system of Commutation in our country in order to reflect the spirit of legislation accurately.
