Study Of China's Development Of E-commerce Legal Issues

With the rapid development of new information technology , internet has become an important communication media and global marketplace . In this situation , Electronic Commerce(EC) has emerged and turned into a new pattern of International Trade .EC has not only changed the traditional pattern of transaction ,also brought many legal controversy over it .Those problems have violent impact on the classical legislation system ,so we should face this challenge and outline a new legal framework adapt to EC.This thesis deals with the EC's law practice and doctrine from four aspects .Chapter one discusses the legal issues of EC contract which concerns with writing form ,offer and acceptance ,signature certificate authority .Chapter two lays emphasis on developed countries ' practice on EC tax legislation ,and brings lessons to our country .Chapter three discusses the protection of EC Intellectual Property including Domain Name ,Copyright and Trade Secret. Chapter four discusses the legal conflict on electronic bill of lading .This part also demonstrates the International Trade innovations in EC and EC's application in China's foreign trade .Finally ,it comes to the conclusion that we should build up a predictable legal environment governing EC as soon as possible ,in order to foster the great development of EC .
