Analysis Of The Value Orientation Of The Administrative Procedure Act And Its Associated Factors

The increasing complication of social life and regulation cause the rapid expand of administrative authority. The legislative wave of administrative procedural law, the regulation of administrative action, correspondingly becomes spectacular in the whole world. Whether or not the law makes it to purpose is inextricably linked with the design of the value targets. Not only runs through the administrative procedural law, the value target, the soul of the law, is also a significant basis and criterion of its enactment, execution, interpretation and evaluation. This article attempts to inquire into the two contents justice and efficiency and their relationship of the core of all values of administrative procedural law, and tries to reveal the trend of the evolution of administrative procedural law, and also analyses the influential factors of the choice of value targets of legislation of administrative procedural law of our country. On this base, the thesis makes it clear that the legal values of Chinese Administrative Procedural Law must put the justice on the first place and put the efficiency on the second place. In the prelude, the thesis reviews the course of development of procedure theory that reflects the rule of development of law. In the first part, the thesis discusses the theory of value patterns.
