Illegal Trial Of The Tang Dynasty Liability System

The accountability system of unlawful trial is a veiy important legal system to ensure the fairness of justice.Tang Dynasty provides us with a paradigm of this system.In order for reference for establishing and improving the accountability system of unlawful trial under current situation ,the study on this system in Tang Dynasty is produced.This dissertation is divided into four parts.Part I:the social ground for the accountability system of unlawful trial in Tang Dynasty.In this part, the author analyzes the ground for the accountability system of unlawful trial in Tang Dynasty,which is a combination of the experience and lessons learned from preceding dynasties ,the political and judicial situation in early Tang Dynasty and the ideology of the rulers at that time.Part II:content of the accountability system of unlawful trial in Tang Dynasty .After a brief analysis of the components ,the assumption of the accountability and the ways of assumption of the accountability under the accountability system of unlawful trial in Tang Dynasty,the jurisdiction,filing,hearing,judging and enforcement of the case under the system are systematically introduced in this part.Part III:the implementation of the system in Tang Dynasty.Various cases are analyzed in this part,some of which are in compliance with the corresponding law,some are not completely in compliance with the corresponding law,and some are not in compliance with the corresponding law at all.Part IV:evaluation of the accountability system of unlawful trial.The effect of the accountability system of unlawful trial is objectively assessed in this part.The concrete causes of each achievement and failure are also analyzed in this part.Adding to the above four parts,the preface and concluding remarks in this dissertation brief us the implications and enlightement of the study of the accountability system of unlawful trial in Tang Dynasty.
