Legal Property Rights Of The Company Research

According to the Party's document and our law,this paper rewiews some majore opinions on legal person's property rights of corporation,and believes that the rights are comprehensive rights that have interests and are enjoyed by corporation.The legal person's property rights of corporation include real rights(proprietary rights and other real rights),creditor's rights,intellectual property rights and stockholder's equity.Corporation enjors legal person's property rights,and stockholder enjoys its equity.The relationship between them is independent and interactional.When our country is becoming a stockholder,!! only enjoys stockholder's rights and doesn't enjoy the other propertyrights.What's more,it has much advantage.Then in accordence with the historical changes on property rights system of Roman Law,Germanic Law,Continent Law and Common Law,and by the demond of social and economic development,this paper rewies the legal property rights of corpration again,and thinks that,in reality,the economic time makes corporation important function in society.The traditional Continent Law can not rationally interprete legal persons rights of corporation. So this paper give a new concept to this issue and this relationship,and think new concept is important to new society and economy.
