Legislative Protection Of Computer Software Model Study

Now, we are in an information society. Though the IT industry in the whole world has been in low tide for about two years, many people still hold the optimistic opinion that the sky of the internet economy will change sunny soon. The development of computer and the technology interrelated with computer has brought around newly emerging things such as internet copyright, computer software, date base and domain name, which have brought forth new shock wave to the traditional law system.Now, the legislation protection of computer software is still an important problem in spite of so many years' discussion. And this problem hasn't been solved thoroughly up till now. This article begins with detailed analysis of the history, main problem, advantages and disadvantages of the protection to computer software by copyright law, patent law and trade secret law. Then, this article gives a demonstration of legislation mode of protection to computer software from the angle of legislation construction in information society, and cons ides that it is a realistic selection at present to apply the comprehensive system based on copyright law including other laws. But in the long term, we should establish special law department, that is, industry copyright law to provide special protection to computer, software. Though this point of view isn't new and original to some extent, but the way of thinking and demonstration may bring around some enlightens to the dispute of legislation law protection to computer software.
