On Our Civil Procedure Construction Of Pre-trial Proceedings

In rencent years,people have raised a proposition about setting up and improving the preparing procedure before hearing in our country.This proposition is based on rethinking the pattern of immediate opening a court nowadays.This thesis just expounds the preparing procedure before hearing in four aspects.Firstly,the author makes clear that it is necessary to improve this procedure,by ways of listing and analyzing what it is povided in current laws as well as what is commonly seen in judicial practices.Secondly,viewed from the comparison of foreign countries' judicature,they have all set up the preparing procedure before hearing accordingly,though the pattern of lawsuit in every country is different.This deserves our learning from.Thirdly,the author make a further analysis of this procedure with regard to its value function,which can ensure the impartiality and benefit of lawsuit.Consequently,this procedure is of course an alternative to every country.Last,standing upon our reality,the author comes up with some specific tentative ideas and some questions paid attention to,which are considered from the purpose of setting up this preparing procedure before hearing.
