On The Compensation For Moral Damage The Legislative Defects And Further Improvement

China's compensation for mental injury has not been approved until the breakthrough of the traditional socialist theory of law since 1980's.However,the limitations still exist,owing both to the traditions on the theory and the civil law itself,and to the contemporary circumstances as politics,economy and culture.With the social development and public elevation,both the law and the notion start to catch up with the world pace,and the limitations appear more constantly in accedemy and judiciary.For this purpose,this article gives an analysis on the present situation of legislation as well as the mis-leadings,concludes several defects and insufficiency on conception,application and contradiction on metal injury damages,and therefore,provides suggestions for reaccomplishment.
