Legal status of private party in the administrative process is a await deep research field in administrative law. The viewpoint in this dissertation is the legal status of private party has changed from the subjection inactivity and passiveness in tradition to the independence activity and initiative in modern times. This dissertation researches the historical changes of the private party in four main occidental advanced capital countries as England,the US France and Germany by the way of the positive analysis and points out the law of the legal status of private party from the subjection inactivity and passiveness to independence,activity and initiative. After that this dissertation analyses the legal status of the private party theoretically from the point of view of the rights of the private party. At last,this dissertation researches the changing course of the legal status of the private party in our country,and ponders rationally on how to improve the legal status of the private party in our country and perfect the legal systems concerned,and offers a peephole view of my own.
