The ultimate aim for legislation is the protection of human rights, which also necessitates the discussion whether the guarantee and realization of human rights process is undergone by following the basic principle of respect of human rights. In judicial practice, human rights have been considerably undermined. As a gradual process, the guarantee of human rights will become more and more prominent with the development of the society. In this passage, the author focuses on the guarantee of the rights of criminal witness. By analyzing the concept and historical origin of witness system home and abroad, the author points out the shortcomings in our present witness guarantee process and puts forward suggestions for its improvement. Concrete measures and theoretical reasoning have also been done.In Chapter one, the author makes a detailed analysis of the basic knowledge about witness, while emphasizing the concept, features, qualification, classification, status and function of witness.In Chapter two, an introduction is made about relevant legislation for the protection of witness rights and remaining issues have also been discussed by analyzing the causes from the perspective of ideology, economy, and culture.In Chapter three, in order to solve the above-mentioned issues, the author proposes a solution on the system layer, by drawing thoughts from the past and present practices in China and in the West.In Chapter four, the author puts forward concrete measures for the protection of witness rights from six aspects with theoretical reasoning.
