Study Of The Russian Federation And Judicial Reform

In the process of our country's judicial reform, there are many common grounds between the two countries in tradition of law ; and both countries face many common problems face many common problems in the process transforming from plan economic system to market economic system, finally, as developing countries, they are emulating the west advanced countries. Furthermore, Russia's judicial reform had a lead over our country, so it provides a lively model, experiences and lessons for China. This article thoroughly studies Russia's judicial reform, from the viewpoint of history and by applying positive analysis, induction and deduction.The article is divided into four sections:Introduction. In this part, the significance and reason for choosing the topic and the conditions of Russia' judicial reform is introduced.Part one: the system reform of judicial mechanism, this section analyses deeply reform of status and task of judicial organs, reform of judicial mechanism, rise of judge's status, and reform of judgment and implementation institution.Part two: the legislation reform in judicial area. It mainly includes constitutional law criminal law and criminal procedure law, civil law legislation. Reform of constitutional law judicial area means the reform of constitution safeguard, which includes three parts: self-safeguard of constitution, safeguard from Federal President and unconstitutional scrutiny from constitutional court.Part three: evaluation and analysis of Russia's judicial reform. From Russia' judicialreform, the author turn over to think.-Judicial reform should be designed and pushedon the base of actual level of country's economic and social condition; judicial reform is bound by a common cause with politics; reform should not be designed to be a type of misconstructions and instant collapse, concrete reform must be harmonized with the whole judicial reform.Russia's judicial reform enlightens our country's: the sustained and stable development of economy is the prerequisite of judicial reform; we should build special Judicial Reform Association, which guides and supervises the whole judicial reform; the line of law's should give function and directness to the whole process; recognize accurately the orientation of value and goal of judicial reform.
