A Number Of Difficult Problems. Robbery Study

Some difficult problems of robbery were seriously studied via the combination of theory with practice. Furthermore, problems existed in the theory and found in practice at present were also discussed and evaluated. This paper consists of four departments as follows: (1) The cognizance of robbery method. In this part, the object and degree of violence means, the types and content of coercive method, and the properties and special expression of other methods were all analyzed thoroughly and literally. (2) The robbery objects and targets. The target included and excluded in the crime of pillage was studied in the juridic practice and some new views were produced. (3) The cognizance of eight aggravating circumstances in the crime of pillage. The extent of "family status" was defmited and the problems of "naturalization" formal and the others seven aggravating circumstances exist in theory and practice were also discussed, which included of some innovative views. (4) Transferring crime of pillage. The established conditions and noted problem of quasi-robbery and constructive robbery were analyzed. The analysis shows that the premise of quasi-robbery is the "behavior" not the "crime", the new opinion of extent and expression of "carrying lethal arms" was promoted also, which have guiding role in the practice to some extent.
