Object Of The Scope Of Our Patent Research

Invention patent, utility patent and design patent are regarded as patent's object by our patent law. Meanwhile, the ranges of the patent's object are confined by our patent law, which is embodied in fifth and twenty-fifth clauses. We have set up a system to protecting the patent's object now, which fits for our country.Now, along with the rapid development in computer, biological engineering, electron business, the protection to the patent's object are becoming behind. The range of the .patent's object is facing serious challenge. So, more and more people pay their attention on it.The thesis introduces the present protection situation of patent's object all over the world at first. In the second section, relating to the present protection to patent's object in our country we analyze the confined range of patent's object in our country. We clarify that the range of p'atent's object is facing challenge with the development of science and economic; Moreover , we analyze the enlarging range of patent's object has brought effect on the three kinds of patent's object when we revised the patent law in 1992 and when, we canceled the twenty-seven notice of the National Property Bureau in 2000. We clarify that the enlarging range of the patent's object has enhanced the development of science and economics. In the three section we emphasize and analyze that the high-technologies in biological engineering, computer , electricity-business are bringing more and more effect on the range of patent's object and they make the range of patent's object extended. We put forward that we should adjust the range of patent's object in time with the development of science, economics and era,especially, the high-technologies which are of our own superiority should be entered the range of patent's object in order to be protected by patent law. We think that will improve our competition in high-technologies in the world and enhance the economic development of our country. It is so important in patent's strategic research that we should focus more attention on it. In addition, we should take into account that extending the range of patent's object should fit for the development of science and economics of our country. Therefore, in the fourth section, we put forward how we should adopt strategic to face the intentional trend of extending range of patent's object: we should improve the enterprise's innovation and develop the high-technology. On the other hand, we should draw up the investigating criterion to the patent application according to the situation of our country.
