Patent Law A Number Of Philosophical Reflection

In the 21st century, with the science and technology developing drastically, economical globalization and freedom are accelerating rapidly, Our country's socialist market economy is being perfected, reform and opening is deepened and widened continually, technology and knowledge involved in the domestic and international economy. Under such circumstances, with the WTO members tax reduction and the elimination of non-tariff barriers gradually, the problem of patent protection attracts more and more attention of each country's government and concerned circles, therefore, it becomes the common action of various countries to enhance the patent legislation and judicial practice. To suit the need of this trend, it is urgent to consolidate the rational analysis and probe of patent law. Based on this background, this thesis is to probe the problem of patent law from the angle of philosophy. In the first place, it is to trace the history of patent law's production and development, then, it is to research the social economy and culture's basis and theories of patent law. In order to give more rational suggestions and guidance to the legislation and judicial practice of our country, this thesis illustrates the internal and external reasons of the charges of the patent law's subjects and objects, combining with methodologies of economical analysis and law sociology, revealing the value directions.
