Executive And Legislative History Of The United States And France Comparative Analysis

Through the comparison analysis to America, French and China's administrative legislation history, this article research the reason and the rule that administration legislative power produces from the legislative power, achieves the goal to correct understanding administration legislation.The first part is the preface. Through the analysis to " administrative legislation " , this article use the research technique and the content to makes a research to the administrative legislation developing process, which adopts the historical inspection and the comparison analysis method. Second, three, four parts are American, French and China's administration legislation history. Through to historical research, induces the developing process of the administrative legislation. In America's research part stress case; in France's research part stress constitution system; and in China's research part stress practice. The fifth part is the comparison analysis to the reason of administrative legislation. The separation of powers is one various countries' constitutionalism instruction theory, and it also are one barrier which the administrative legislation produces. Through the analysis from exterior factor and internal factor two aspects, this article research the reason of administration legislation' produces. The sixth part is the comparison analysis to the development of administrative legislation. The author thinks that the administrative legislation mainly experienced three stages, and through the analyses to three stages, the author thinks that the the production and the development of administrative legislation is the historical necessity.
