| A large number of international trade disputes has been widely concerned about how to settle these disputes peacefully and effecti.vely. The panel procedure of GATT /WTO is showing a great importance in settling disputes in respect of international trade, and is now playing more and more significant role in the dispute settlement mechanism (DSM) of GATT/WTO. Compared with GATT panel procedure, the panel procedure of WTO raises efficiency of dispute settlement , due to its judicial feature and strict procedure which strengthen reliability of developing nations on this mechanism. As China has acceded to WTO, we should strenthen research about the panel procedure, and prepare for the future disputes with other members after joining in WTO. On the basis of studying a great quantity of relevant articles and cases, this paper analysis the legal resources of the panel procedure and its history, summarizes its several characteristics , and points out that this procedure is a further transform to the panel procedure of GATT, provided with remarkable creativeness, and have great historical significance to the development of international law. In the conclusion , the author studies the development and improvement of the panel procedure of WTO and puts forward some constructive countermeasures. |
