Our country has profoundly changed since reformation and opening developed in the last 20 years of the 20th century. People's concept of marriage and family is changing, the relationship between marriage and family is founding newly, and function of marriage and family is uninterruptedly updating. Relationship of marriage thinned, family diminished. Under this situation, relationship of near relatives, which has legal rights and obligations has taken the place of the primary relationship of marriage and family. At the same time, the adjustable relationship in Marriage Law is changing from marriage and family to near relative. Now, in our country, the most important work is to perfect lawmaking of relative system, because we have many shortages in this field. Argumentation surround the problems thai have been bring forward in this text. It consists of four parts as following:Part one is summarize on relative system. This part chiefly introduces the basal knowledge of relative and relative system, which includes the conception, the origin and development of relative system, and the relationship between relationship and Marriage Law, also and other systems.Part two put emphases on shortages in Marriage Law of the People' s Republic of China. We find our lack when we look back the history and see about the actuality. In our Marriage Law, we haven't general regu-lation on relative system. Cohabitation and separation system between husband and wife, parentage ~ enactment system between parents and children don't exist. We are short of leading lawmaking in some fields.Part three is a compare of relative system between China and foreign countries. This part recommends the general regulation of relative system , cohabitation and separation system, parentage - enactment system in foreign countries.Part four discusses perfect lawmaking. The text talks about this topic from content and structure. Adding the general regulation of relative system, cohabitation and separation system, parentage - enactment system to our Marriage Law is suggestion form penman. Moreover, some rights and obligations between relative in - law should be enlarged. On structure, penman also brings forward a new idea.
